Forensic Title Examination

A Forensic Title Examination integrates public land records with private transfer activity to identify gaps, breaks, and inconsistencies in the recorded chain of title.

This is not a review of what is recorded—it is an analysis of whether the record itself is complete and coherent.

Forensic Analysis of Title Records, Conveyances, and Recording Integrity

A Forensic Title Examination is a record-based investigation of the public land records to determine whether interests in real property have been properly created, transferred, recorded, and preserved.

Drawing on extensive experience auditing Registries of Deeds across the United States, this service examines what the land records actually show—and whether the recorded chain of title supports the ownership, lien, or enforcement rights being asserted.

The objective is not to assume defect, but to determine whether the public record is complete, legally coherent and intelligible based on both public and private sources of information.

I reconstruct what the records actually show—whether in the numbers or the chain of title.

Purpose of This Examination

A Forensic Title Examination is designed to:

  • Reconstruct the chain of title using recorded instruments
  • Identify gaps, breaks, or irregularities in conveyances or assignments
  • Evaluate whether recorded documents are consistent with asserted interests
  • Detect late recordings, backdated instruments, or anomalous recording patterns
  • Assess the integrity of the public record as it relates to ownership or lien rights

This work is grounded exclusively in recorded documents, registry practices, evidence of unrecorded transfers, and documentary chronology.

Scope of Review

Depending on the nature of the matter, a Forensic Title Examination may include:

  • Reconstruction of the chain of title from the Registry of Deeds
  • Researching unrecorded transfers involved in secondary market sales and securitization
  • Review of deeds, mortgages, assignments, releases, and substitutions
  • Analysis of recording dates, execution dates, and sequencing
  • Identification of missing, duplicative, or inconsistent instruments
  • Examination of notarial irregularities or execution anomalies
  • Evaluation of registry indexing and recording practices
  • Integration of recorded documents with transactional or servicing records

Findings are presented with document citations, timelines, and registry references.

How This Work Is Used

Forensic Title Examination is commonly relied upon in:

  • Foreclosure litigation and standing challenges
  • Disputes involving ownership or lien priority
  • Matters involving securitized or transferred mortgage loans
  • Mediation or arbitration involving title or recording issues
  • Preparation of expert affidavits and reports
  • Policy, regulatory, or institutional review of recording practices

This examination often supplies the foundational factual record upon which other forensic or expert work depends.

Professional Boundaries

This service involves forensic document and title analysis. I do not provide legal opinions regarding title validity or marketability.

My role is to identify what the public land records demonstrate, how recorded interests were created or transferred, and whether the recorded chain supports the positions being asserted.

Who This Service Is For

  • Attorneys litigating title, foreclosure, or standing issues
  • Homeowners challenging asserted ownership or enforcement rights
  • Mediators and arbitrators evaluating title-related disputes
  • Matters involving complex transfers, securitization, or registry anomalies
  • Institutions or municipalities reviewing registry integrity

Why This Step Matters

Real property rights rise and fall on what the public record shows.

A Forensic Title Examination brings clarity to that record—allowing courts and decision-makers to evaluate claims based on the integrity, continuity, and content of the land records themselves.
